PUBLIC NOTICE
New legislation for Georgia Contractors, Subcontractors, Businesses and Other Public Benefit Applicants will require verification of Citizenship and Immigration Status

In 2006, Governor Sonny Perdue signed into law new requirements for public employers, contractors, and those applying for public benefits within the State of Georgia. The Georgia Security and Immigration Compliance Act (Senate Bill 529) mandated public employers to register and participate in a federal work authorization program to verify information of all new employees. This law also made it illegal for public employers to enter into contract for physical performance of services with contractors and subcontractors not registered and participating in a federal work authorization program. For individuals using Georgia’s public services, access was authorized by the Department of Homeland Security, through the SAVE Program, for verification of legal presence in the United States to determine eligibility.
The SAVE Program is inter-governmental initiative designed to aid benefit-issuing agencies, institutions, licensing bureaus and other entities in determining an applicant’s immigration status, and thereby ensure that only entitled applicants receive federal, state, or local public benefits and licenses.
Effective January 1, 2010, amendments to House Bill 2, will apply additional rules and regulations relating to verification of new employee information, contracting and subcontracting, and administration of public benefits for the City of Moultrie as follows:
- The federal work authorization program User ID and Date of Authorization issued to the City of Moultrie will be available at http://www.moultriega.com
- Human Resources will require all new hires applying for group health and retirement benefits to complete a signed and sworn affidavit affirming lawful presence in the United States.
- Individuals on behalf of and Applicants of Business Licenses, Alcohol Licenses, Taxicab Licenses, Insurance Licenses, Occupation Tax Certificates, Auctioneer, Pawn Broker, Massage Therapists, Billiard Room Operation, Precious Metal and Gem Dealer, Flea Market, Peddlers and Itinerant Traders, Transient Business, Fortune Telling and Palmistry, but not limited to other miscellaneous licenses, will be required to sign a sworn affidavit indicating lawful presence in the United States.
- Prior to consideration of any bid, Contractors must provide certification of registration and participation in a federal work authorization program by submitting a signed notarized affidavit. In addition, contractors must agree to employ or contract with subcontractors that are in compliance with O.C.G.A. 13-10-91.
- Subcontractors must provide certification of registration and participation in a federal work authorization program by submitting a signed notarized affidavit, before entering into contract.
Contractors and subcontractors who have NOT registered in a federal work authorization program should contact the Georgia Department of Labor or visit http://www.dol.state.ga.us for applicable rules and instructions.
